Heard learned counsel for the petitioner and learned A.G.A for the State.
Learned counsel for the petitioner has submitted that the present mattter is a matrimonial matter and the said matter can be well considered by the Mediation Centre of this Court.
After having gone through the entire facts and circumstances on record in the light of the contention of the learned counsel for the petitioner, I do find it expedient that the parties should be given an opportunity to arrive on a compromise therefore, it is directed that the petitioners shall deposit a sum of Rs. 10,000/- within two weeks from today with the Mediation Centre of which 75% shall be paid to the private opposite party for appearance before the Mediation Centre.
The matter is hereby remitted to the Mediation Centre of this Court with the direction that the same may be decided after giving notice to both the parties.
It is directed that the Mediation Centre shall decide the matter expeditiously, preferably within a period of two months. Thereafter, the case shall be listed before the appropriate Bench on 30.8.2010.
Till the next date of listing, further proceedings of Case No. 1543 of 2010 (Smt. Raina Vs. Krishna CHandra Sharma and others) u/s 498-A, 323, 504, 506 IPC and 3/4 D.P.Act, P.S. Kotwali, district Jhansi, pending in the Court of Chief Judicial Magistrate, Jhansi shall be kept in babeyance. After depositing the aforesaid amount, notice shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, the interim protection granted above shall automatically stand vacated.
