1. Applicant Niraj alias Bauwa has filed this application under Section 439 Cr.P.C. for bail in Case Crime No. 60 of 2012 under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act (in short 'Gangsters Act'), Police Station Safipur, District Unnao.
2. Learned counsel appearing for the applicant contnes that the Gangsters Act has been invoked in view of allegation that applicant has committed offence under Section 302 I.P.C. Applicant has been released on bail in that case. The other co-accused of the applicant in this case crime number has been released on bail, as would be evident from the order dated 29.3.2012 in Case Bail No. 2052 of 2012, Ram Lal alias Gogey V. State of U.P. Even Irfan, shown at serial no.3, Gang Chart, Annexure-2, is on bail.
3. Facts as stated have not been disputed by learned counsel appearing for the respondent-State.
4. I have considered the contention of the learned counsel for parties and gone through the record.
5. Considering the facts and circumstances of the case, this application for bail of applicant Niraj alias Bauwa, is allowed.
6. Bail to the satisfaction of the court concerned.
