JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.9900 OF 2004 DATED 12TH SEPTEMBER, 2014 Between:
Nimma Saroja … Petitioner and The Mandal Revenue Officer, Bejjanki, Karimnagar District and others … Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.9900 OF 2004 O R D E R This writ petition was filed assailing the action of the authorities in not furnishing the report of the survey of the petitioner’s premises bearing house No.1-56 in Sy.No.644-A of Bejjanki village, Karimnagar District. A further declaration was sought that the action of the respondent authorities in constructing an office building in the premises of the petitioner was illegal along with a direction to pay compensation to the petitioner. This Court, while ordering notice before admission in the matter on 18.06.2004, directed the respondent authorities not to make any construction in the petitioner’s land. This direction was extended until further orders on 02.07.2004.
Today, the learned Government Pleader for Revenue produced a copy of the spot inspection report of the Assistant Director, Survey and Land Records, Karimnagar, which was signed by him on 10.04.2003. Perusal of the report reflects that the rain gauge of the MRO’s office in Bejjanki was constructed partly in Sy.No.644. Learned Government Pleader states on instructions that an extent of 25 guntas in Sy.No.644 was affected by the said construction.
The above facts establish that construction was made by the respondent authorities in Sy.No.644 also. The respondent authorities do not claim that the land in Sy.No.644 is Government land. In that view of the matter, as the petitioner claims interest in an extent of land falling within Sy.No.644, which is stated to be sub-divided as Sy.No.644-A, it shall be open to her to approach the competent Civil Court to establish with evidence that her property was adversely affected by the admitted construction of the MRO’s office in Sy.No.644 of Bejjanki village and seek appropriate relief, including compensation for illegal and unauthorized occupation and usage, if any.
With the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
