JUDGMENT / ORDER

The form of the petitioner for B.T.C. Training-2010 which was sent by speed post on 05.06.2010 much before the last date of submission i.e. 08.06.2010 has not been accepted and has been returned undelivered.
Learned counsel for the petitioner has placed reliance upon the Division Bench decision of this Court in the case of Ramendra Srivastava Vs. State of U.P. and others [(2009) 3 UPLBEC 2458] wherein the Court ruled that the petitioner should not be penalised if the forms are sent within time but are not delivered in time due to postal delay.
Learned Standing Counsel prays for and is allowed two weeks' time to seek instructions and to file counter affidavit.
List thereafter.
In the meantime, the Respondent No. 4 is directed to accept the application form of the petitioner provisionally, if the same are personally submitted before him by the petitioner within a week from today.
