JUDGMENT / ORDER

This petition under Article 226 of the Constitution of India invokes the extraordinary power of this Court against the concurrent findings of the fact as well as law by the Courts below in as much as the complaint filed by the applicant before the learned Judicial Magistrate, First Class, Gandhinagar, for the inquiry against respondent Nos. 2 to 5 and for directing police to inquire about the false documents created by respondent No.2, came to be dismissed having no merit as per the order dated 29.5.2008 passed by the learned Judicial Magistrate, First Class, Gandhinagar, in Enquiry Case No.10 of 2008 on the basis of the police report that the entire issue is based on civil nature and, against exercise of powers by the learned Magistrate and dismissing the complaint under Section 203 of the Code of Criminal Procedure, 1973, revision application being Criminal Revision Application No.72 of 2008 also came to be dismissed by the learned Additional Sessions Judge and Fast Track Judge, Gandhinagar, by order dated 30.11.2010, where, basically reliance is placed on the pending revenue proceedings between the parties and the nature of dispute was of civil nature. In the above context, no interference is called for and no case is made out to entertain the present petition. This petition is rejected summarily.
