Nilesh vs State

In view of the affidavit in reply filed by the complainant and pendency of application for further investigation filed by the complainant under Section 173[8] of the Code of Criminal Procedure, 1973, contention of the learned advocate for the petitioner that Section 498A of the IPC is not applicable to the applicant since he is not a relative, will be considered after the decision of the learned Magistrate on the above application for further investigation preferred by the complainant.
