Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Nilesh Shankar Dixit@Neelu who is involved in Case Crime No. 296/2017, under Sections 147, 302, 427, 34 I.P.C., Police Station- Gyanpur, District Bhadohi.
It is contended by learned counsel for the applicant that applicant has no criminal antecedent. Co-accused Bhunwar @ Khushiyal Yadav and Rahul Dixit were named in the F.I.R., who have been enlarged on bail by this Court vide orders dated 20.12.2017 & 22.02.2018 passed in Criminal Misc. Bail Application Nos. 50080/2017 and 6564/2018 respectively. The role of applicant is similar to that of co-accused Bhunwar @ Khushiyal Yadav and Rahul Dixit.
Learned A.G.A. has opposed the prayer for bail and admitted this fact that named accused Bhuvar and Rahul Dixit have been enlarged on bail.
The role of applicant is similar to that of co-accused Bhunwar @ Khushiyal Yadav and Rahul Dixit.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Nilesh Shankar Dixit@Neelu be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
