Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that applicant was stranger. Neither he is owner nor he was inside the shop, nor he was preparing Masala. In fact as per allegations, co-accused Kishan was preparing Masala. Even Chemical Examiner Report has not been received as yet to establish that there was any adulteration. However, the applicant is in jail since 22.5.2010.
In this view of the matter, without expressing any opinion on merits of the case, let the applicant namely, Nilesh Kumar @ Anoop Kumar be released on bail in Case Crime No. 134 of 2010, under Sections 272/273 I.P.C., P.S. Chetganj, District Varanasi on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned Order Date :- 23.6.2010 S.A.A.Rizvi
