Order:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.4, in restoring the dealership of fair price shop No.26 of Ayyavaripalli of Valmikipuram Mandal to respondent No.6 through the proceeding in D.Dis.No.(A3)/4865/2014, dated 10-12- 2014, and the action of respondent No.3, in summarily rejecting the petitioner’s application for interim suspension of the said proceeding, pending appeal, as illegal and arbitrary.
On a careful consideration of the first part of the prayer sought by the petitioner, this Court is of the opinion that the said prayer is wholly misconceived, for, the petitioner has already approached respondent No.3 by filing an appeal against the impugned proceeding, dated 10-12-2014, of respondent No.4. Having availed a remedy of appeal, the petitioner cannot avail a parallel remedy by filing the present Writ Petition.
As regards the prayer for declaring the action of respondent No.3 in rejecting the petitioner’s application for interim suspension as illegal, the petitioner has not filed a copy of the said order on the ground that the same has not yet been supplied to her. This Court is at a loss to know as to how it can address the petitioner’s grievance without examining the order of respondent No.3. The petitioner appears to be in a hurry to approach this Court without even waiting for supply of a copy of the order passed by respondent No.3.
For the above-mentioned reasons, the Writ Petition cannot be entertained and the same is, accordingly, dismissed.
As a sequel to dismissal of the Writ Petition, WPMP.No.49619 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
