The Counter affidavit filed by Sri Mahendra Pratap Singh posted as District Backward Social Welfare Officer, Jaunpur, specially the averments mentioned in paragraph 10 thereof, reflects that the University Administration has provided the list of eligible candidates, but due to paucity of fund the fee could not be reimbursed. It has been fuhrer contended that efforts are being made to arrange the fund and as soon as the arrangement of fund is made, same will be reimbursed on preferential basis.
This affidavit was filed on 09.03.2011 and since then more than four months have elapsed, but it is not clear as to whether arrangement of fund has been made or not. In such a situation and in this background, learned standing counsel is directed to inform the Principal Secretary, Higher Education, Government of U.P. Lucknow to file his personal affidavit before this Court as to whether fund has been arranged or not, and in case the arrangement of fund has not been made, then the reason behind the same be disclosed.
