JUDGMENT / ORDER

P.B.Suresh Kumar, J.
This appeal is preferred against the decree and judgment in O.S.No.299 of 2010 on the file of the Court of the Principal Subordinate Judge, North Paravur.
2. The suit O.S.No.299 of 2010 was one for specific performance of an agreement for sale.
3. As per order dated 24.11.2014, the parties were directed for mediation and the mediator has filed a report on 27.11.2014 stating that the disputes have been settled by the parties at the mediation. The terms of settlement entered into between the parties is also forwarded to this Court.
4. In the light of the settlement arrived at between the parties, the impugned decree and judgment in O.S.No.299 of 2010 are set aside and the appeal is disposed of in terms of the settlement. In view of the provision contained in section 69A of the Kerala Court Fees and Suits Valuation Act, the entire court fee paid by the appellant shall be refunded to him. The interim order of injunction granted by this Court as per order dated 18.1.2012 in I.A.No.202 of RFA No.47/2012 2 2012 is vacated and a communication to that effect shall be issued by the Registry to the Village Officer, Manjapra Village and to the Sub Registrar, Ankamaly Sub Registry.
A copy of the terms of settlement, as forwarded by the Mediator, shall be appended to this judgment and the original thereof shall be preserved.
