Heard Sri Vimal Kumar Pandey, learned counsel for the petitioners and learned AGA for the State.
Learned counsel for the petitioners submitted that petitioner no.2 Kripakant Dubey allegedly has executed so called "Vaivahik Ghoshnapatra" signed by Niharika Singh petitioner no.1, Kripakant Dubey, petitioner no.2 and Jagatpal Das Tyagi dated 30.04.2019/02.05.2019.
In paragraph five of the petition it has been clearly mentioned that petitioner no.2 has already married and his wife is alive and living with him and during subsistence of first wife the petitioner no.2 has executed aforementioned "Vaivahik Ghoshnapatra", which is nothing but amount of demotury that cannot by the petitioner no.2.
I do not find any good reason to exercise my discretion in favour of the petitioners, accordingly the present habeas corpus writ petition is dismissed.
