Learned counsel for the applicant is permitted to make necessary correction in the prayer of the memo of application.
This application under Section 482 Cr.P.C. has been filed with the prayer to stay the proceedings of Criminal Case No. 33061 of 2017 (Jitendra Kumar Singh Vs. Nihaluddin), under Section 138 of Negotiable Instruments Act pending before the 2nd A.C.C.M., Kanpur Nagar as well as N.B.W. dated 13.9.2018 issued against the applicants.
Heard learned counsel for the applicant and learned A.G.A.
Earlier applicant approached this Court through Application U/S 482 No. 21435 of 2018 and vide order dated 19.6.2018 it was disposed of the application with the direction to the applicant to surrender before the Court concerned within the specified period.
It appears that applicant has not complied with the direction given in the aforesaid order passed by this Court. Thus the court below had no option but to issue non bailable warrant against the applicant.
Keeping in view the conduct of the applicant, the application is dismissed.
