This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Nigam Chauhan in the event of his arrest in Case Crime No. 156 of 2019, under Section 419, 420 and 406 I.P.C., P.S. Kulhui, District Mahrajanj.
Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The allegation in the matter appears to be serious in nature involving a large scale of fraud whereby several people have been inflicted with the economic loss and money belonging to them has been dishonestly taken away from their accounts. The total amount of money is also huge sum which is several lakhs. In a matter like this, the interrogation of the applicant appears to be very essential for fair investigation and this Court does not want to put a spanner in the regular course of investigation and it must be allowed to have its full swing. No good ground for grant of anticipatory bail is made out in favour of the applicant .
Accordingly, the prayer for anticipatory bail is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
