JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition under Section 438 Cr.P.C. 2. Petitioner is the 3rd accused in Crime No.1641/2014 of Paravur Police Station, Kollam district pending investigation for the offences punishable under Sections 498A and 306 read with Section 34 IPC.
3. Deceased Sunisha was given in marriage to the 1st accused. After the marriage, she was residing at the matrimonial house along with the 1st accused, his mother the 2nd accused and his younger brother the 3rd accused. She was being harassed and tortured to the maximum. Every now and then she was being beaten up severely by demanding more dowry. Finally, the girl had no other go than to commit suicide by jumping in front of a running train on 18.09.2014 at the railway track at a place called Kuzhikarathazham.

4. Heard learned counsel for the petitioner and learned Public Prosecutor.
5. The contents of the CD, prima facie, reveal the complicity of the petitioner. There were tortures and harassments from the part of the petitioner also. The investigation has revealed that the 1st accused had gone abroad on the next morning of the death of the deceased. It has further come out that the present petitioner is indulging in threatening and intimidating all the neighbours from giving any information or furnishing any statement before the police regarding the true state of affairs happened at the house on the dates prior to the incident. Much discussion is not required to conclude that the petitioner is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
