Petition filed under Section 439(1) Cr.P.C. 2. Petitioner is the sole accused in Crime No.387 of 2014 of Kareelakulangara Police Station registered for the offences under Sections 304 and 308 IPC.
3. The prosecution case is this: The petitioner was a driver of a bus. With the knowledge that he is likely to cause death of others he drove the vehicle along the National Highway in a rash and negligent manner, as a result of which it hit against a car causing death of four persons travelling in it and causing injuries to others. According to the prosecution he has thus committed the offences mentioned above. The petitioner prays that since he has been in custody since 5.4.2014 he may be released.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The investigation is not complete. If the petitioner is released on bail at this stage, the possibility of his intimidating or attempting to influence the witnesses cannot be ruled out. So I am not inclined to grant his prayer.
In the result, this application is dismissed.
