Heard Sri Chandan Kumar Chaturvedi, learned Counsel for the petitioners, learned A.G.A. for the State and Sri Pradeep Kumar Yadav, learned Counsel for opposite party no.4.
This habeas corpus petition has been filed by the petitioner with the allegation that petitioner no.1, Smt. Nidhi Kumari (corpus) and Deepak Kumar (petitioner no.2) both are major and they have solemnized marriage but corpus Smt. Nidhi Kumari was under illegal detention of respondent no.4, who is father of corpus. This Court vide order dated 2.8.2021 directed the respondent nos. 4 and 5 to produce petitioner no.1, Smt. Nidhi Kumari (corpus) before this Court. In compliance of order dated 2.8.2021 Smt. Nidhi Kumar (corpus) is present before this Court and on being asked she has stated that she is residing with her father with her own will and there is no illegal detention. It is further submitted that she is willing to go with her father.
In view of the statement of Smt. Nidhi Kumari (corpus), since there is no illegal detention of Smt. Nidhi Kumar, this petition is liable to be dismissed.
