JUDGMENT / ORDER

The petitioner's vehicle bearing registration No.KL-09-C-559 has been seized by the respondent alleging that it was involved in transporting river sand without permission. The petitioner seeks for a direction to the respondent to release the vehicle and that he is prepared to deposit the value of the vehicle involved. The learned counsel for the petitioner submits that the respondent has fixed the value without assessments being made by the competent authority, namely, the Motor Vehicles Department.
2. If the assessments have not been made by the Motor Vehicles Department, there shall be a direction to the respondent to obtain valuation from the Motor Vehicles Department and based on such report, the vehicle shall be released to the petitioner in accordance with law. This shall be done within a period of four weeks.
