Following orders were passed in the matter, vide order dated 21.05.2018 which is quoted herein below:
"Grievance is that though petitioner has secured marks higher than respondent no. 5, and her name was included in the select list after the first counselling, yet her claim has not been considered and instead appointment has been offered to respondent no.5.
Learned counsel representing respondent no. 4 may obtain instructions in the matter. Post as fresh on 30.5.2018."
Sri Awadhesh Kumar, learned counsel for the respondent, has obtained instructions from the District Basic Education Officer, Basti. It is pointed out that the last date of making an application for recruitment was 13th January 2018 by when the petitioner was not even possessing requisite qualification for the post. It is pointed out that the petitioner has completed her TET exam on 17 March 2017. Since the petitioner was not having requisite qualification on the last date of making an application, as such her claim has rightly not been considered. So far as petitioner appearing in 2015 TET exam is concerned, she has admittedly not qualified.
In such circumstances no relief can be granted to the petitioner. The writ petition, consequently, is dismissed.
