JUDGMENT / ORDER

The writ petition is filed by the petitioner seeking for a direction to the respondents to settle the entire bills of the petitioner in respect of the works carried out in terms of Ext.P1.
2. The third respondent has filed a counter affidavit wherein in para.6, it is stated as follows:
"It is hereby submitted that the petitioner is now claiming 2004 schedule rates and 35% excess in respect of the work carried out. The above demand is clear violation of the conditions of agreement entered into between the petitioner and the Public Works Department at the time of granting time extension. The payment due to the petitioner will be given on getting approval from the Government in respect of the revised estimate. There is no willful laches and negligence on the part of the PWD or the Government in disbursement of the bill amount. The entire amount will be paid to the contractor after obtaining permission from the Government. At least six months is required for completing the departmental formalities and for disbursement of the bill amount to the petitioner."
3. Learned counsel for the petitioner states that the time sought for is too much in view of the delay that has occurred in this matter.
4. Having regard to the various factors pointed out in the affidavit, permission will be obtained from the Government for the disbursal of the W.P.(C). No.26150/2010 -:2:- eligible amount to the petitioner and the payment will be effected within a period of four months from the date of receipt of a copy of this Judgment. The writ petition is disposed of as above. No costs.
