Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The applicant is in jail since 2.11.2008 for the offences under Sections 396 and 412 I.P.C. The co-accused Satish has been granted bail by this Court on 26.10.2009 in Crl. Misc. Bail Application No. 28191 of 2009. The co- accused Titto @ Pradeep has also been granted bail on 20.5.2010 in Crl. Misc. Bail Application No. 12709 of 2010. The bail orders are annexed as Annexure-6. Role of the present applicant is identical to that of the co- accused who have been granted bail.
Taking into consideration the facts and circumstances of the case, without expressing any opinion on merits and on the ground of parity, bail application is allowed.
Let the applicant Netrapal alias Nakta son of Sri Daan Sahai, involved in Case Crime No. 203 of 2008, under Sections 396, 412 I.P.C., P.S. Amapur, District Kanshi Ram Nagar, be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
