1. Both these revision applications had been argued at length by the learned advocates for the respective parties and vide order dated 26th December, 2011, the judgment was reserved. However, before the judgment could be pronounced, the parties have amicably settled the dispute between them hence, at the request of the learned advocate for the revisionist, the matters came to be listed today.
2. Today, Mr. Jigar Patel, learned advocate for the revisionist in both the matters has placed on record a copy of a communication dated May, 2012 of the Chairman/Managing Director of the revisionist company requesting him to withdraw both the above numbered civil revision applications in view of the overall settlement arrived at by and between the parties outside the court, alongwith a copy of the terms of settlement arrived at between the parties. Alongwith the said communication, the learned advocate has also placed an undertaking given by the partners of Shyam Realities - respondent No.3.
3. The learned advocate for the revisionist has submitted that in the light of the agreement arrived at between the parties, the undertaking is required to be submitted before this court hence, the same be taken on record. He has further submitted that in the light of the above referred communication, he may be permitted to withdraw both the civil revision applications.
4. In the aforesaid premises, the undertaking is taken on record. Permission to withdraw the revisions as prayed for is granted. Both the above referred civil revision applications are rejected as withdrawn.
