This is second application under Section 482 Cr.P.C has been filed by the applicant for the same relief.
Learned counsel for the opposite party no.2 Shri Pradeep Kumar Sharma has stated that the applicant has already filed a 482 Cr.P.C. No.36849 of 2018, which was dismissed by order dated 1.11.2018, in which following prayer was made;
"for quashing the proceedings of Case No.Nil of 2018 ( State Vs. Nempal and others), under Sections 354(ka)/504/506 IPC and Sections 3(1)(Da), 3(1)(Dha) of the SC/ST Act, P.S. Collector Bookganj, Bareilly."
From the perusal of record, it appears that the second application u/s 482 Cr.P.C is not maintainable for the same relief once the earlier application u/s 482 Cr.P.C has already been dismissed.
It is accordingly dismissed.
