Learned counsel for the petitioner is permitted to implead the Secretary, Board of High School and Intermediate Education, U.P., Allahabad as party respondent no. 5.
The submission of learned counsel for the petitioner Sri A. K. Malviya is that the result of some of the girls students of the petitioner Institution of the High School as well as the Intermediate examination has not been declared. The petitioner has already made a representation in this regard. The only prayer made by learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time.
Learned Standing Counsel does not have any serious objection to the aforesaid prayer.
No useful purpose would be served by keeping this writ petition pending. The writ petition is being disposed of with the consent of the parties.
The matter is remitted to the respondent no. 5, Secretary, Board of High School and Intermediate Education, U.P., Allahabad.
A mandamus is issued to the respondent no. 5 commanding him to pass a reasoned and speaking order on the representation of the petitioner seeking declaration of the result of the students who appeared in the High School and Intermediate examination conducted by the Board. The order shall be passed within a period of two weeks from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
The writ petition is disposed of finally.
