HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22594 OF 2008 ORDER:
Heard learned Counsel for the petitioners and learned Government Pleader for the respondents.
This Writ Petition was filed challenging the action of respondents in seeking to demolish the petitioners’ building consisting of shop rooms and residential house in Sy.Nos.594/1 and 594/1B of Adurupalli village, H/o. Chittalur, Cherjerla Mandal, S P S R Nellore District and dispossess them without initiating proceedings under the Land Acquisition Act.
A counter affidavit is filed by the third respondent stating that the Revenue officials makes it clear to the petitioners that their house is outside the boundary of the R & B land and therefore their building will not be demolished. Pursuant to the same, the petitioners appeared before the Tahsildar, Chejerla and gave a written statement to the effect that they would withdraw the Writ Petition.
In view of the same, no further orders are necessary to be passed in the Writ petition.
The Writ Petition is accordingly dismissed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
