Sri Girijesh Tiwari, learned counsel appearing for the petitioner who is the Principal of Nehru Intermediate College Kushinagar submits that this petition has been filed for the following reliefs.
"(1) Issue a writ order or direction in the nature of mandamus commanding/directing the respondent No 2 to grant prior permission for filling up the 07 vacant posts of Class IV employees in the institution in question forthwith or within the stipulated period as fixed by this Hon'ble Court.
(ii) Issue any other suitable and proper order which this Hon'ble court may deem fit and proper in the circumstances of the case.
(iii) award cost of the writ petition to the petitioners."
The learned counsel for the petitioners submits that the representations are dated 7.11.2018, followed by reminders dated 11.3.2019 and 10,.11.2018 as well as 15.3.2019. However, the request made in the representation has not been acceded to.
Learned Standing counsel appearing for the State submits that the matter shall be examined by the 2nd respondent within the time framed as provided by this Court.
In the circumstances aforesaid, this Court is of the opinion that there is no impediment in dispoing of the writ petition by directing the second respondent to consider the request of the petitioners for filling up vacant class IV posts in the institution in accordance with law, Accordingly, the writ petition is disposed of by directing the second respondent to pass a speaking order on the application of the petitioner dated 7.11.2018 after calling for relevant report from the District Inspector of Schools, in accordance with law, within a period of eight weeks from the date of production of a certified copy of this order alongwith copy of the application dated 7.11.2018 and a copy of writ petition..
