Vakalatnama of Sri Vikrant Gupta, learned Advocate filed today on behalf of respondent is taken on record.
The petitioners herein are present in the court. The petitioner no.1, Neha, daughter of Mohammad Iqbal states that she had married with petitioner no.2 out of her own sweet will and there is no pressure upon her.
The counsel for the respondent no.3, however, states that the petitioner no.1 is a minor girl.
In support of the submission that both the petitioners are major, copy of Aadhar card has been filed alongwith the writ petition.
It is submitted by the petitioner no.1 that she had studied up to Class-VIII and at the time she had left her house she was not studying.
Be that as it may, looking to the allegations in the First Information Report, we do not find any reason to quash the First Information Report, however, it is provided that the petitioners shall not be arrested in the Case Crime No.0348 of 2019 under sections 363, 366 I.P.C. P.S.-Sheeshgarh District- Bareilly till the submission of the Police Report under section 173(2) Cr.P.C.
The statement of the petitioner under section 164 Cr.P.C shall be recorded at the earliest. All efforts shall be made to conclude the investigation. The petitioner shall cooperate in the investigation and shall not make any effort to influence the witnesses.
