Heard learned counsel for the petitioners; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 15.11.2019 registered as Case Crime No. 464 of 2019 at P.S. Charthawal, District- Muzaffar Nagar, under Sections 363, 120-B I.P.C.
The allegation in the impugned first information report is that informant's minor daughter (Neha), who is aged about 15 years, has been enticed away by the accused persons.
Admittedly, petitioners have not been able to produce the victim Neha and they are not in a position to produce document which may suggest that Neha had attained the age of majority.
Under the circumstances, the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail or anticipatory bail, as may be advised.
