This application u/s 482 Cr.P.C. has been moved seeking the direction to the Family Court, Gorakhpur to decide the application dated 12.7.2017 moved on behalf of applicant as Case No.172 of 2017 u/s 128 Cr.P.C. arising out of Case No.628 of 2013, u/s 125 Cr.P.C. (Neha Srivastava vs. Mridul Srivastava and another), expeditiously.
Heard learned counsel for applicant and learned A.G.A. and also perused the record.
It has been made to appear that there is some application dated 12.7.2017 moved on behalf of applicant pending in the court below but so far no orders have been passed on the same and a direction in that regard has been sought by the counsel.
In absence of complete record this Court is not in a position to know the exact status of the proceedings and also about the reasons as to why the aforesaid application has not been disposed of so far. At any rate, this application stands disposed of with the observation that if there is any such application dated 12.7.2017 moved on behalf of applicant still pending and no orders have been passed on the same so far, then the concerned court below shall look into the same and pass appropriate orders expeditiously in accordance with law, as it may deem fit in the facts and circumstances of the case.
