Heard Sri Dinesh Kumar Singh, learned counsel for the petitioner and Sri H.N. Pandey, learned counsel appearing for Central Board of Secondary Education (hereinafter referred as the 'Board'), respondent nos. 1 to 3.
This writ petition has been filed assailing the order dated 12.12.2019 passed by respondent no. 3 whereby the claim of petitioner for correction in the mark-sheet of class 10th examination, has been rejected.
It is contended by learned counsel for the petitioner that the name of petitioner in the mark-sheet of class 10th has been transcribed as "Neha Parak" instead of "Neha Parakh" and mother's name of petitioner has also been wrongly spelt as "Archna" instead of "Archana".
Sri H.N. Pandey, learned counsel appearing for Board, very fairly submitted that in view of the direction of this Court in case of Jigya Yadav (minor) through Guardian/Father Hari Singh Vs. C.B.S.E. and others, Civil Appeal No. 3905 of 2011 decided on 03.06.2021, in case, petitioner moves an application before the institution from which she has appeared in the said examination and the institution further after considering the application sent the same to the Board for correction in the mark-sheet of class 10th examination, the Board will consider and issue corrected mark-sheet after due correction in the name of petitioner as well as in her mother's name.
Having heard learned counsel for the parties and from perusal of the record, petitioner is directed to move an application before the institution respondent no. 5 from which she had appeared in class 10th examination alongwith supporting documents for correction in the school record as desired by her within 15 days from today, the institution in question shall thereafter making necessary changes in the school records shall forward the application to the Board within next 15 days and the Board shall thereafter make every endeavour to issue corrected mark-sheet to the petitioner within next two months.
With the aforesaid directions, writ petition is disposed of.
