Heard learned counsel for the parties.
The petitioner claims to have represented before the Secretary, Basic Education Board, U.P., Allahabad / respondent no.2 under Rule 8(2)(d) of the Uttar Pradesh Basic Education (Teachers) (Posting) Rules, 2008 praying that her transfer from District Rampur to Bareilly on the ground that her parents in laws are old and suffering from various old age ailments. There is no one to look after them. She has made representation dated 29.01.2018 by registered post, which is stated to be pending consideration before the Authority aforesaid.
Sri Vijai Kumar Srivastava, learned counsel appearing on behalf of respondent nos.2 and 3 has objected to the prayer made by the petitioner on the ground that earlier she approached this Court by way of Writ -A No.4594 of 2018, which was disposed of directing her to seek redressal of grievance as per judgement rendered in Writ -A No.2868 of 2018 (Bibha Singh Kushwaha and 21 others Vs. State of U.P. and two others). She has not availed the opportunity provided by this Court by applying on-line.
Learned counsel for the petitioner states that in compliance of the aforesaid order of this Court when she opened the website for applying on-line she found that on-line application has already been filled and forwarded to the Authority concerned with absolutely wrong particulars and thereafter she had made compliant in this regard and also first information report has been lodged with the police under the Information and Technology Act.
The fact remains that the grievance of the petitioner raised by means of representation dated 29th January, 2018 before the respondent no.2 has neither been considered nor redressed till date.
In view of the facts and circumstances of the case, the writ petition is disposed of finally directing respondent no.2 to take appropriate decision on the representation dated 29.01.2018 of the petitioner within a period of three weeks from the date of presentation of a certified copy of this order.
