Heard Sri Anurag Dubey, learned counsel for the applicant and learned A.G.A. appearing for the State.
As per the prosecution case, three nominated accused persons and one other caused fire arm injury; postmortem examination report reflects 16 injuries caused by gun shot; role of firing is assigned to the applicant and Sonu Yadav; recovery of assault weapon has been made from the applicant and Sonu Yadav.
Learned counsel for the applicant submits that prosecution witnesses have turned hostile and have not supported the prosecution case.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that assault weapon has been recovered from the applicant. It is not in the public interest to enlarge the applicant on bail Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant, Neetu Yadav, involved in Case Crime No. 590 of 2017, under section 302, 34 I.P.C., Police Station Kotwali, District Mainpuri.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis within four months from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
