Heard learned counsel for the applicant and learned counsel for the State as well as perused the record.
This repeat bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant, seeking enlargement on bail during the trial in connection with Crime No.84 of 2016 under Sections 302 and 120-B of IPC, Police Station Pilua, District Etah.
Earlier bail application of the applicant was rejected by this Court, vide order dated 23.10.2017.
Counsel for the applicant submits that the complainant has been examined as PW-1 and he has not stated anything adverse against the applicant.
Opposing the bail application, it has been argued by learned State Counsel that there are other eye-witnesses also to the incident who, till date, have not been examined.
Considering the facts and circumstances of the case, in particular the fact that there are number of eyewitnesses to the incident, who are yet to be examined, I am not inclined to release the applicant on bail. His repeat bail application is rejected. However, trial Court is directed to make all endeavour for early disposal of trial.
