Heard learned counsel for the parties.
The primary prayer made in the writ petition, reads thus:
"A. To issue a writ, order or direction in the nature of certiorari quashing the impugned first information report dated 31.10.2017 in Case Crime No. 721 of 2017, under Section 363, 366 I.P.C. and Section 7/8 Protection of Children from Sexual Offence Act, Police Station Tarya Sujan, District Kushinagar (Annexure-1)."
Mr. Syed Ali Murtaza, learned AGA, on instructions, submits that a Charge Sheet bearing no. 01/2018 dated 06.05.2018, has already been filed, and in view thereof, this petition renders infructuous.
The petition is, accordingly, disposed of as infructuous. It is, however, open to the petitioners to take appropriate remedy, if they so desire and are advised, for appropriate relief.
