Heard learned counsel for the petitioner and Shri B.B. Pandey, learned Additional Chief Standing Counsel for the respondents.
The only grievance of the petitioner is that her appeal No.C201818000001416 of 2018 (Neetu Jain vs. Government of UP and another) under Section 13 (1) of U.P. Essential Commodities Act, 2016 is pending before respondent no.3 but the same has not been decided so far.
Learned Standing Counsel fairly states that in case the appeal is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.2 to consider and decide petitioner's aforesaid appeal by a speaking order within a period of three months from the date of production of a certified copy of this order before him.
Meanwhile, if any allotment is made, the same will be subject to the decision of the appeal in question.
