Learned counsel for the parties are ad idem that the principal controversy which is addressed on this petition stands concluded in light of the decision rendered by a learned Judge of the Court while disposing of Writ-A No. 10207 of 2018, Ankit Kumar & Ors. Vs. State of U.P. & Ors.
While disposing of the said petition, the learned Judge had noted the submission on behalf of the State in the following terms.
"6. Sri Ajit Kumar Singh, learned Additional Advocate General assisted by Dr. Y. K. Srivastava, learned Chief Standing Counsel for the State submits that notice issued on 13th April, 2018 has since been modified on 17th April, 2018 and the previous notice of 10th April, 2018 stands restored. It is stated that all applicants, who had applied and have obtained marks above the cut off in their respective category would be called for their document verification and medical examination test, so as to conclude the recruitment exercise by issuing appointment orders.
7. In view of the fair stand taken by the State before this Court, not much survives for adjudication in the present writ petition.
8. This writ petition, accordingly, stands disposed of noticing the stand of the State that all applicants, who have scored marks above the cut off in their respective category, would be called for document verification and medical examination etc. and would be considered for appointment, in accordance with law, and that relief would not be restricted to petitioners of the earlier writ petition alone."
Learned Standing Counsel, on instructions, points out that the only window which was left open was that it be inquired into whether the petitioner had obtained more than the cut off marks. According to him, the petitioner has not obtained the minimum cut off in her respective category.
In view of the above, the Court finds no ground to entertain this petition any further, which is consequently dismissed.
