Heard Sri Kshitij Shailendra, learned counsel appearing on behalf of petitioner and learned Standing Counsel for State respondents.
Sri Kshitij Shailendra, learned counsel for petitioner has submitted that the present case is for transfer of the petitioner who is working as Assistant Teacher in Firozabad and her case for transfer from Firozabad to Allahabad is under consideration before the respondent No.4, Additional Director of Education (Secondary) Uttar Pradesh, Prayagraj. He further submitted that order dated 25.03.2019 passed in Writ A No. 3845 of 2019 (Savita Tripathi Vs. State of U.P. and 11 Others) wherein petitioner is also arrayed as respondent No.8 cannot be treated as impediment for deciding the issue of transfer of the petitioner. He has also relied upon the order dated 25.03.2019 which is reproduced hereinbelow:
"Learned Standing Counsel accepts notice on behalf of respondent nos. 1 to 5.
Let a counter affidavit be filed in the matter bringing all such facts on record.
Notices need not be issued to respondent nos. 7 to 12 at this stage and question of notices to them would be considered after the counter affidavit is filed.
Counter affidavit will be filed within three weeks from today. Rejoinder affidavit will be filed within a week thereafter.
List thereafter.
Any action taken in the meantime shall abide by the outcome of the writ petition. "
Learned counsel for petitioner further submitted that the petitioner had already moved a representation dated 28.05.2019 before the respondent No.4. However, the same is not considered till date. He further submitted that time period prescribed for transfer as per the State policy is till 30.06.2019.
In these circumstances, the writ petition is disposed of with direction to respondent No.4 who shall decide the representation made by the petitioner at the earliest in accordance with law.
