Pursuant to the previous order passed Sri J. N. Maurya, learned Chief Standing Counsel has obtained instruction, which is taken on record.
Sri Rohit Pandey, learned counsel appearing for the respondent University points out that petitioner had earlier approached this Court by filing Writ Petition No.43598 of 2015 wherein the relief claimed is virtually the same as is the relief sought in the present petition. It is also pointed out that the aforesaid writ petition is pending and the petitioner has not disclosed its pendency in the present petition.
The Court does not approve of filing of fresh petition when the issue in substance has already been raised by the same petitioner in his earlier petition and the same is pending. It appears that that is why University has not been impleaded as a party or else such facts may not have been placed. Since the petitioner has appeared in person as such this Court is not inclined to observe any further.
This writ petition is, accordingly, dismissed with liberty reserved to the petitioner to raise all his grievance, including the grounds urged in the present petition, in his earlier pending Writ Petition No.43598 of 2015.
