Heard Sri Rajeshwar Singh, learned counsel for the revisionists and Sri Irshad Hussain, learned A.G.A. for the State.
The present crl. revision has been preferred against the judgment and order dated 1.6.2018 passed by Additional Sessions Judge, Court no7,Azamgarh in S.T.No.47 of 2018 (State Vs. Neeraj Singh and others), arising out of Case Crime No.30 of 2016, under Sections 323, 308, 504, 506 I.P.C., P.S. Saraimeer, District Azamgarh whereby the application of revisionists for no case is made out under Section 308 has been rejected.
Learned counsel for the revisionists has submitted that the injury which has been sustained by the injured is manipulated one and no offence under Section 308 I.P.C. is made out against the revisionists.
I have perused the impugned order dated 1.6.2018 passed by passed by Additional Sessions Judge, Court no.7,Azamgarh in the aforesaid case and find that the same does not suffer from any illegality or impropriety. Hence the revision lacks merit. It is liable to be dismissed and is, accordingly, dismissed.
