Learned counsel for the petitioner submits that the application for reevaluation could not be submitted in time since the copies were provided by the respondent University only on 25.08.2018. The date for submission of application form for reevaluation had expired by the aforesaid date. The petitioner cannot be faulted since he was precluded from filing an application for reevaluation on account of the delay on the part of the respondent University to provide the copies of the answersheets.
The only prayer made by learned counsel for the petitioner is that the copies of the petitioner may be reevaluated.
Sri Narendra Pratap Singh, learned counsel for the respondent University does not have any serious objection to the aforesaid prayer. He, however, submits that the petitioner shall be required to deposit the requisite fee for reevaluation.
No useful purpose would be served by keeping this writ petition pending. The writ petting is being disposed of with the consent of the parties.
The matter is remitted to respondent no. 3, Registrar, Bundelkhand University, Jhansi.
A mandamus is issued commanding the respondent no. 3 to ensure that the answersheets of the petitioner in the papers of Quantum Mechanics and Nuclear Physics of B.Sc. III year regular examination are reevaluated. The petitioner shall make an application in the appropriate form and deposit the fee within a period of two weeks. In case such form is deposited within the aforesaid period, the form shall be entertained and the marksheet shall be reevaluated within a further period of one month. The result of the reevaluation shall be intimated to the petitioner. This direction shall not be applicable in case the answersheets have been weeded out as per law.
The writ petition is disposed of finally.
