Heard learned counsel for the parties.
Petitioners claim to be working in the Industrial Establishment of the Irrigation Department, Meerut and came to be appointed after 1 April 2005. By the instant writ petition, petitioners, seven in number, are assailing the order dated 27 March 2019 passed by the second respondent, Superintendent Engineer, Irrigation Division Lucknow rejecting the claim of the petitioners entitlement under the old pension scheme. It is noted in the impugned order that the petitioners case is not covered by the Government Order dated 12 August 2016 as the petitioners were not employed with the State Government or any of its establishment prior to 1 April 2005.
On specific query, learned counsel for the petitioner admits that the appointment of the petitioners is after the cut of date i.e. 1 April 2005.
Learned Standing Counsel submits that in similar circumstances this Court in Rakesh Kumar Tripathi and others vs. State of U.P. and others (Writ-A No. 10719 of 2018) has rejected the claim of the petitioners to be included under the Old Pension Scheme.
In view thereof, the petition being devoid of merit is, accordingly, dismissed.
No cost.
