Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent nos.1 and 4, and Sri Ravi Praksh Pandey, learned counsel for the respondent nos.2 and 3.
By means of this writ petition, the petitioner is challenging the order dated 30.05.2019 passed by the Vice Chairman, Varanasi Development Authority-respondent no.2 by which the map has been sanctioned in favour of the respondent no.5.
Sri Ravi Prakash Pandey, learned counsel for the respondent nos.2 and 3 has raised a preliminary objection and states that against the order impugned, the petitioner has a statutory alternative remedy of approaching the State Government under Section 41 (3) of U.P. Urban Planning and Development Act, 1973.
In view of the availability of efficacious remedy, we are not inclined to interfere in the matter. The writ petition is, accordingly, dismissed on the ground of statutory alternative remedy.
