Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent Nos.1 to 5.
In view of the order proposed to be passed, notices need not be issued to the private respondents.
The petitioner has preferred the present writ petition inter-alia with the following prayer:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding the Joint Director of Education, Agra to transmit his papers regarding the inter-institutional transfer to the Additional Director of Education (Secondary), Prayagraj so that appropriate action may be taken in the matter.
(ii) Issue a writ, order or direction in the nature of mandamus commanding Additional Director of Education (Secondary), Prayagraj to pass formal orders regarding the said transfer application of the petitioner."
It is argued that though the papers regarding inter-institutional transfer was duly forwarded by the District Inspector of Schools, Firozabad to the Joint Director of Education, Agra on 22.05.2019 but till date no action has been taken. It is further argued that as per provisions contained in the Act, Joint Director of Education concerned is duty bound to forward the aforesaid papers to the Additional Director of Education (Secondary), Prayagraj.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally directing the respondent No.3/ Joint Director of Education, Agra to forward the necessary papers before respondent No.2/Additional Director of Education (Secondary), Prayagraj within a period of three weeks from the date of production of a self attested computer generated copy of this order downloaded from the official website of High Court Allahabad before him.
The respondent No.2/Additional Director of Education (Secondary), Prayagraj is directed to pass appropriate orders on the same within a period of one month from the date of receipt of papers from the office of respondent No.3/Joint Director of Education, Agra.
