Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondents to award average marks in English subject equal to the other subjects of Intermediate Examination Year 2019 and declare the result within stipulated time.
The contention of learned counsel for the petitioner is that the petitioner appeared in English subject in Intermediate Examination-2019 but she was shown as fail and has secured zero marks in the said subject. It is further contended by learned counsel for the petitioner that the petitioner appeared in the examination and applied for scrutiny and also applied for inspection of copies under the Right to Information Act, but the copies has not been supplied to the petitioner for seeing the same.
No useful purpose would be served by keeping this writ petition pending.
Under these circumstances, respondent no.3-Secretary, Board of High School and Intermediate Education, U.P. at Allahabad (Prayagraj) is directed to pass appropriate order on the petitioner's application filed under the Right to Information Act on 22.5.2019, copy of which is appended as annexure-3 to the writ petition, as expeditiously as possible, preferably within a period of three weeks from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
