Heard learned counsel for the applicant and Ms. Sanyukta Singh, learned A.G.A. appearing for the State.
This bail application moved on behalf of applicant praying to enlarge him on bail in Case Crime No.26 of 2019, under Sections 354(Ka), 307, IPC, Police Station Sarai Mumrej, District Prayagraj.
The contention of the counsel for the applicant is that the applicant has been falsely implicated in the present case. The present bail application has been pressed solely on the ground that the applicant is languishing in jail since 09.01.2019.
Ms. Sanyukta Singh, learned AGA appearing for the State has strongly opposed the prayer for bail with the contention that there are injuries on the neck of the victim, which are the knife injuries; much reliance has been placed on page no.18 of the bail application, which is injury report of the victim; that further contention is that the applicant was caught at the spot; the attention of the Court has also been drawn to the statement of the victim under Section 164 Cr.P.C, copy of which has been annexed on page no.29 of affidavit filed in support of the bail application.
Looking to the aforesaid facts, no case for grant of any indulgence has been made out.
Accordingly, the application for bail is rejected at this stage.
