The petitioner is seeking expeditious disposal of case no. 3830 of 2003 arising out Case Crime No. 592 of 2000, under Section 420 IPC at PS Kotwali, Lakhimpur Kheri against opposite parties concerned (1) Vishnu Kumar Suredha, S/o Sita Ram Surekha, R/o 14-B, South Extension, Part-II, New Delhi, (2) Smt. Premlata Surekha, W/o Vishnu Kumar Surekha, R/o 14-B South Extension, Part-II, New Delhi and (3) R.S. Modi, S/o Radha Krishna Modi, Managing Director, Wising India Ltd., (actually residing at 23-A, Shah Industrial Estate, Beera Desai Road, Andheri West, Mumbai On the ground that in the aforesaid case, Charge Sheet against Vishnu Kumar Surekha submitted on 18.01.2003 vide Charge Sheet no. 10/03 and subsequently another Charge Sheet has been submitted against R. S. Modi on 09.05.2007 whereas no charge sheet has been filed against Vishnu Kumar Surekha . The case is pending before the Court of Additional Chief Judicial Magistrate-II, Lakhimpur Kheri. Charges against Vishnu Kumar Surekha has also been framed but till date the case has not proceeded. The non-bailable warrant against R.S. Modi, who is in Mumbai has already been issued but till date same has not been executed.
About ten years have passed but it appears that the case has not proceeded substantially. Considering the facts and circumstances, I hereby issue direction to the District and Sessions Judge, Lakhimpur Kheri to monitor the case and get it expedite.
In the aforesaid term the Criminal Miscellaneous Case is disposed of.
