Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed on behalf of the applicant with a prayer to quash the summoning order dated 5.7.2017 along with entire criminal proceeding of complaint case no. 1328/2016 (Ravindraveer Singh vs. Neeraj Agarwal), under Section 138 N.I. Act, P.S.- Saroorpur, District- Meerut, pending in the court of Judicial Magistrate Sardhana, District Meerut.
Upon consideration of the various aspects of the matter and upon consideration of various documents brought on record and a perusal thereof by this court, whatever grievance the applicant has, he can meet the same by raising appropriate plea before the court concerned only and is required to participate in the proceeding. It is expected that the objection raised by the applicant shall be duly considered by the court below and appropriate order will be passed thereof.
However, the applicant may be allowed to participate in the proceeding on condition that he shall remain present and will cooperate in the proceeding of the case.
With the aforesaid observation, this application stands disposed of.
