Heard learned counsel for the applicant and learned A.G.A. for the State.
By way of the instant application, the applicant has prayed for quashing the further proceedings of complaint case no. 641 of 2016 (Ravindraveer Singh Vs. Neeraj Agarwal) under section 138 N.I. Act P.S. Saroorpur district Meerut pending in the court of Judicial Magistrate, Sardhana district Meerut.
At the outset prayer has been made to this effect that the applicant is desirable to participate in the proceedings of the lower court and he may be provided one last opportunity, he will not absented himself from the proceeding and he will also make payments of the amount involved in this case.
However, taking into consideration the facts and circumstances of the case, it is provided that in case the applicant appears before the court concerned within two weeks from today and moves application for bail, the same shall be considered and disposed of by the court below, expeditiously, if convenient, on the same day.
For a period of two weeks from today, no coercive action shall be taken against the applicant.
It is made clear that in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicant.
With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
