The instant petition is directed against the order dated 24.1.2019 by which the Prescribed Authority has rejected the application seeking amendment in written statement in P.A. Case No. 16 of 2017 under Section 21 (1) of U.P. Act No.13 of 1972.
The court below has recorded a finding that the amendment sought was in the knowledge of the petitioner since the very beginning but the application seeking amendment was filed when the matter was posted for hearing. It has also been observed that the pleading sought to be introduced are already there in the written statement.
At this stage, the Court is not inclined to interfere with the impugned order being interlocutory in nature, but leaves it open to the petitioner to challenge the same alongwith final order in case occasion arises for filing an appeal.
The petition stands disposed of accordingly.
