This application has been filed with the following prayer:
"It is therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the present application and quash the Charge sheet No.47 of 2019 dated 09.05.2020 in Case No. 47 of 2019 dated 09.05.2019 in Case No.632 of 2020 (State Vs. Neelu @ Shrikant @ Neelesh and Others), arising out of Case Crime No.0025 of 2019, Under Sections 41, 102 Cr.P.C. and Section 411 I.P.C., Police Station- Bichhwa, District Mainpuri, pending in the court of Judicial Magistrate- I, Mainpuri, District Mainpuri.
The FIR dated 30.01.2019 was lodged under sections 41/102 Cr.P.C. and section 411 IPC. The applicant is named in the FIR.
The contention of learned counsel for the applicant is that the applicant was not apprehended at the spot but was named as a co-accused in the FIR itself. It is contended that some indulgence may be granted to the applicant so that he may apply for bail in the court below.
However, considering the facts and circumstances of the case, I do not find it a fit case for interference under section 482 Cr.P.C. It is for the applicant to move the court below by filing appropriate application for an appropriate relief. This Court, in exercise of its jurisdiction under section 482 Cr.P.C., declines to issue any direction in this regard.
This application is accordingly dismissed.
